  1. Overview

Daitaas LLC (“Daitaas”) offers subscriptions that give members (“Members”) the opportunity to create company profiles and upload data, and files to facilitate its use of Daitaas’ Tilley, Vasture and Datanac services in accordance with the terms of their respective subscription agreements. Additional services may also be offered from time to time as described and under the terms set out on the website (“Website”) and in this Agreement. Our services are collectively referred to in this Agreement as “Services.” Additional services may also be offered from time to time as described and under the terms set out on the Website and in this Agreement.

Daitaas' Website and Services are available to users [in the continental United States / worldwide / North America]. Given the nature of Daitaas' service, we anticipate that users will be utilizing our Services for business purposes. The types of information entitled to privacy protection, sometimes called data protection, vary by jurisdiction. Most of the information that we collect will be business, not personal information. In some jurisdictions, your email address may be treated as personal information. If your business is a sole proprietorship and you use your social security number for tax purposes, then it will also include this number. This Privacy Policy describes how Daitaas will use the personal information collected when you visit the Website or utilize our Services. Your subscription agreement addresses how Daitaas will use your business information. We may supplement this Privacy Policy with additional privacy terms or with additional privacy notices in connection with certain features of our Services.

This Privacy Policy does not apply to websites or mobile platforms that do not incorporate this Privacy Policy. Further, this Privacy Policy does not apply to third-party websites or services, including, without limitation those of any third-party data sources. We encourage you to review the privacy policies posted on those websites and mobile platforms. Links to our third-party data sources’ websites are provided for your convenience in Section 3 of the Terms of Service.

  1. What Information We Collect About You and Why?

We collect information from you in two ways: directly from your input and automatically through our Service’s technologies.

A. Information provided by you: The types of information we collect directly from you may include the following as well as any other information type that we expressly ask you to enter and submit to us either through the subscription application or later as you upload information to support your use of our Service:

  • Contact information, such as your name, company name, title, physical addresses, email addresses, telephone numbers and avatar photo;

  • Usernames and passwords;

  • Application and data-specific comments and feedback;

  • Compliance Interests, searches, and communication preferences.

  • Crop yield data, specific to your Farm Serial Number

  • Crop acres grown, specific to your Farm Serial Number

  • Financial data associated with your farming business

  • Budgets and financial projections associated with your farming business

  • Data from government forms such as Farm Service Agency forms FSA 578 and 156EZ and Commodity Credit Corporation form CCC 866

B. Information Collected Automatically: We automatically collect certain information regarding your use of our website and Service. Examples of information collected automatically include:

  • Internet Protocol (“IP”) address used to connect your computer to the Internet;

  • Computer, device and connection information, such as browser type and version, operating system, mobile platform and unique device identifier (“UDID”) and other technical identifiers;

  • Uniform Resource Locator (“URL”) click stream data, including date and time, and content you viewed or searched for on a Service.

C. Information Collected by Our Vendors: If you choose to purchase a product or service through our Website, we will direct you to a third-party service provider to process your payment by credit card. The third party will collect from you contact information (such as your name, address, and e-mail) and financial information (such as credit card number and expiration date). We do not collect or receive a copy of your credit card information.

D. Cookies and Web Beacons: We may also automatically collect information through the use of cookies or similar technologies, such as web beacons. Cookies are small text files that a website sends to the browser on your computer or mobile device when you first visit a web page so that the website can recognize your device the next time you visit. Most websites typically use the following:

  • “Session cookies,” which are temporary and deleted when you close your browser;

  • “Persistent cookies,” which remain until you delete them or they expire;

  • “Web beacons”, which are electronic images also known as single-pixel gifs.

In general, cookies, web beacons and similar technologies do not contain personally identifiable information, but when you furnish your personal information through the Service, this information may be linked to the non-personally identifiable data stored in cookies sent to your browser from the Service.

Daitaas and its service providers may use these technologies for various purposes, including: facilitating the login process, administering, customizing and improving the Service, personalizing the browsing experience; advertising, promotions and surveys, reporting and paying royalties and license fees to third-party providers, such as authors, societies and other copyright holders and content distributors as well as tracking and analyzing user preferences and trends.

There are a number of ways for you to manage cookies. The “help” portion of the toolbar on most browsers will tell you how to stop accepting cookies, how to be notified when you receive a new browser cookie, and how to disable existing browser cookies. However, if you block cookies, you may not be able to register, log in or make full use of the Service. You may also use your mobile device’s settings to manage the available privacy options.

Our HTML-formatted emails may contain a web beacon to tell us whether our emails are opened and verify any clicks through to links or advertisements within the email. We may use this information for purposes including determining which of our emails are more interesting to users, to query whether users who do not open our emails wish to continue receiving them and to inform our advertisers in aggregate how many users have clicked on their advertisements. The web beacon will be deleted when you delete the email. Emails in plain text rather than HTML will not include the web beacon.

D. Handling of Personal Information; Covenants; Permissions; Rights: Laws concerning the handling of disclosure and use of personal information vary widely around the world. As used in this policy, the terms “personal information” and “personal data” are interchangeable, but the scope of information included in them and the protections afforded them vary from jurisdiction to jurisdiction. In its broadest definition, personal information and personal data refer to any information from which a person can or may be identified. Daitaas is located in the United States of America. We generally store submitted information on servers located in the United States of America but may store or process submitted information in other countries.

When you provide information to Daitaas, including personal data or personally identifiable information or personal data relating to others, you represent and warrant that (i) you have complied with, and will continue to comply with, all applicable laws relating to the collection, use and disclosure of such information, (ii) you have made all required notifications and obtained all required consents and authorizations from such persons relating to the disclosure of such information to a third party service provider, and (iii) you acknowledge and consent that Daitaas may use and disclose automatically collected information for any purpose, except where we are restricted by applicable law. Daitaas may aggregate information that it collects. We may create and use de-identified data sets for any purpose, when it does not identify specific individuals and so is not personal information. All such de-identified data is our property and our right to use it will survive our relationship with you. If we combine any automatically-collected information with personal information, the combined information will be treated by us as personal information.

  1. Use of Your Personal Information

Daitaas uses the personal information collected through the Service to complete various actions:

  • for data analytics;

  • for price/risk analysis;

  • for financial projections;

  • to assist you with user-initiated loan applications;

  • to assist you with user-initiated insurance applications;

  • to assist you in completing a transaction or order;

  • to build custom reports;

  • to provide and improve service and support;

  • to update you on relevant new services and benefits;

  • to personalize the Service and to select content to be communicated to you or to use features on the Service such as sharing content;

  • to contact you regarding our products or services or other products and services from third parties;

  • for audits, developing new products, enhancing the Service, identifying usage trends and determining the effectiveness of our promotional campaigns, or in other ways to which you have expressly agreed in a customer agreement with us;

  • to prevent and detect security threats, fraud or other malicious activity;

  • to analyze and automate service and offer activity;

  • and to comply with our legal obligations, resolve disputes, and enforce our agreements.

Daitaas may on occasion also match or combine the personal information that you provide with information that we obtain from other sources or that is already in our records, whether collected online or offline or by predecessor or affiliated group companies, for the purposes described above.

  1. Sharing or Disclosing Your Personal Information

With your permission, Daitaas may share your personal information in the following ways:

  • Government Agencies. Your personal information may be accessible to government agencies when you use our Service to submit information.

  • Lenders. Your personal information may be accessible to lenders when you use our Service to submit loan applications and other forms.

  • Agents, Representatives, Sponsors and Business Partners. Your personal information may be accessible to our agents, representatives, sponsors and entities for which we are acting as an agent, licensee, joint venturer or publisher.

We may share personal information in order to: (i) respond to or comply with any law, regulation, subpoena or court order; (ii) investigate and help prevent security threats, fraud or other malicious activity; (iii) enforce and protect the rights and properties of Daitaas or its affiliates; or (iv) protect the rights or personal safety of our employees and third parties on or using our property.

  • Change in Corporate Circumstances. If Daitaas, the Service or a related asset or line of business is acquired by, transferred to or merged with another company, your personal information may be disclosed to the prospective or actual purchasers.

  1. Cross-Border Transfer of Personal Information

Your personal information may be transferred for processing to countries outside of your country of residence. By using the Website or Service you consent to the transfer of information to countries outside of your country of residence. This is important for you to understand because the country where your information is transferred may have different personal data protection rules than in your country. In addition, by using Daitaas’ Website or Service you confirm your understanding and agreement as follows:.

You may request access to personal information about you that you have provided to us through the websites or mobile platforms governed by this policy. You may also request to review and correct any of that personal information. Additional rights may also apply under applicable laws. The Service may allow registered users to access their registration information and make corrections or updates. The accuracy of such information is solely the responsibility of the user. Daitaas uses a variety of data security measures intended to ensure the confidentiality and integrity of your personal information. These include administrative, technical, and physical security measures. These measures include computer safeguards, secured files, and secured facilities. We take reasonable steps to securely destroy or permanently de-identify personal information when we no longer need it. We will keep your online information only as long as we must deliver our services, unless we are required to keep it for a longer period by law, or until you withdraw your consent or otherwise object to our continued use of your personal data as provided by applicable laws.
